Gay Marriage Is Now a Constitutional Right in the United States of America

On Friday, the Supreme Court issued a 5 to 4 decision in favor of same-sex unions.

The first line of the U.S. Supreme Court’s decision in Obergefell v. Hodges, on the legality of same-sex marriage in the United States, is as breathtaking as it is legalistic.
“The Fourteenth Amendment requires a State to license a marriage between two people of the same sex and to recognize a marriage between two people of the same sex when their marriage was lawfully licensed and performed out-of-State.”
There it is, the ruling that gay-marriage advocates and opponents have been waiting for since April when the Court took up the case—but really, for years long before that. There is now a constitutional right for people of the same sex to get married in the United States.
In the Court’s opinion—authored by Justice Anthony Kennedy, a Catholic who has long been seen as the possible swing vote on gay marriage, joined by Justices Stephen Breyer, Ruth Bader Ginsburg, Elena Kagan, and Sonia Sotomayor, and with four separate dissents authored and joined by combinations of  Samuel Alito, John Roberts, Antonin Scalia, and Clarence Thomas—lists four major reasons for its decision in Obergefell. First, Kennedy writes that “decisions about marriage are among the most intimate that an individual can make.” Allowing LGBT people to marry is a matter of personal choice and autonomy, just as it was in the Court’s 1967 in the case Loving v. Virginia, which outlawed bans on interracial marriage.
Second, Kennedy writes, marriage is a distinctive institution: “It supports a two-person union unlike any other in its importance to the committed individuals.” Here, he points to the Court’s opinion in Griswold v. Connecticut, which affirmed the right of married couples to use birth control. “Same-sex couples have the same right as opposite-sex couples to enjoy intimate association.”
But then, the decision takes an interesting turn: The Court seems to flip the oft-used reasoning of same-sex marriage opponents, who claim that gay marriage is harmful to children and families, and disruptive to the longstanding order of American society. In the oral arguments for Obergefell, several justices raised this very question—even Breyer, who joined in the decision, said that marriage between a man and a woman “has been the law everywhere for thousands of years. Suddenly you want nine people outside the ballot box to require states to change [this configuration].” But on Friday, Breyer joined four of his colleagues to do exactly that.
“Protecting the right to marry is that it safeguards children and families and thus draws meaning from related rights of childrearing, procreation, and education,” Kennedy writes. Not all straight married couples have children, and they’re certainly not required to do so by law, he reasons; the same rule should apply to gay married couples. But more importantly, for those gay couples that do want to have kids—including the many, many couples who adopt or have children using the genetic material of one parent—seeing their unions as less than marriage under the law creates a “more difficult and uncertain family life. The marriage laws at issue thus harm and humiliate the children.”
Finally, Kennedy affirms that marriage is “a keystone of the Nation’s social order.” It is the institution at the center of the United States’ legal and educational structures, and because of this, “it is demeaning to lock same-sex couples out of a central institution of the Nation’s society, for they too may aspire to the transcendent purposes of marriage.”
“Rising from the most basic human needs, marriage is essential to our most profound hopes and aspirations,” Kennedy writes. This is, perhaps, the most striking argument of all, for it is an argument about the nature, significance, and dignity of marriage itself. “The ancient origins of marriage confirm its centrality, but it has not stood in isolation from developments in law and society,” Kennedy writes, but the “institution—even as confined to opposite-sex relations—has evolved over time.”
The dissents from Alito, Roberts, Thomas, and Scalia are scathing. The Chief Justice argues that the Court has stepped far beyond its bounds, stating simply, “this Court is not a legislature.” Like his colleagues in the majority, he delves into the history of marriage, even giving a nod to one of the favorite arguments of gay-marriage opponents: that legalizing gay marriage is essentially a slippery slope. In fact, he writes, the leap from heterosexual marriage to same-sex marriage is “much greater than one from a two-person union to plural unions, which have deep roots in some cultures around the world.” His conclusion: “The majority expressly disclaims judicial ‘caution’ and omits even a pretense of humility, openly relying on its desire to remake society according to its own ‘new insight’ into the ‘nature of injustice.’ … Just who do we think we are?”
Scalia’s dissent carries a much more mocking tone—indeed, he says he concurs with Roberts entirely, but is writing a separate dissent to “call attention to this Court’s threat to American democracy.” He diagrams several of Kennedy’s sentences and states his astonishment at “the hubris reflected in today’s judicial Putsch.” His main objection is that the Court has stepped beyond the boundaries of the law—not just in Obergefell, but over the course of several recent decisions. “With each decision of ours that takes from the People a question properly left to them—with each decision that is unabashedly based not on law, but on the ‘reasoned judgment’ of a bare majority of this Court—we move one step closer to being reminded of our impotence,” he writes.
Opponents of same-sex marriage have long argued that the institution of marriage is sacred, and that gay unions would change its very nature. They have contended that it has been historically defined as a union between one man and one woman, and that the Court does not have the authority to change that definition. With this decision, Kennedy, and the Supreme Court of the United States dissent.

Vacancy at presidency: couple defraud professor of $38,000

The Economic and Financial Crimes Commission (EFCC) today arraigned a couple, Prince Alphonsus Mbakwe and his wife, Mrs Florence Mbakwe before Justice Lawal Akapo of the Lagos State High Court on a five-count charge bordering on obtaining money by false pretence and stealing.

The couple allegedly defrauded one Professor Uchenna Elike by claiming to help him secure a consultancy job in the Presidency.

One of the EFCC counts read against the couple reads:
“that you Prince Alphonsus Mbakwe between 2010­ and 2014, in Lagos, within the jurisdiction of this honourable court, by false pretence and with the intent to defraud ,obtained the sum of Thirty-eight Thousand Four Hundred United States Dollars ($38,400), from Professor Uchenna Elike by falsely representing to the said Professor Uchenna Elike through Mr. Chidiebere Igbokwe and Mrs. Chinwe Igbokwe that vacancy existed in the Presidency, Abuja, for the appointment of Professor Uchnenna Elike as Consultant and that you were in position to influence the said appointment and that the money you obtained from him represented the cost of your logistics, accommodation, flight and facilitation fees for the said appointment, which representation you knew to be false.’’
The couple pleaded not guilty to the charges. In view of their plea, the prosecution counsel, G.C Akaogu prayed the court to fix a date for trial and to remand the accused persons in prison custody.

The Presiding judge, Justice Lawal Akapo ordered that the accused persons be remanded in EFCC custody and adjourned the matter to June 30, 2015 for hearing of the bail application.

NASS crisis: Saraki writes APC, says 'My hands are tied'

Senate President Bukola Saraki has written to the leadership of his party, APC , on why he could not follow their directive on the appointments of principal officers in the Senate. According to Senator Saraki, the letter from the party stating its choices of party members to fill the principal positions, came after another APC caucus in the house had met and selected their choice for principal officers.

He stated that as much as he would have loved to respect the position of the party, his hands were tied as parliamentary rules and standard have to be followed. A copy of the letter after the cut.. Inside the home of a man married to a sex doll

Dirk and Jenny aren’t like normal couples. Their sentiments are: to love one another, to support one another and to share a lot of their private time together. The only thing that sets them apart is Jenny is a ‘real doll’ that Dirk bought for 6,000 euros (that’s $6,750).
Dirk and Jenny have a fixed daily schedule. Every evening at 6 pm they are sitting on the sofa watching television
They have been living together in Dirk’s flat for 4 years now, after Dirk suffered a breakdown from feeling lonely. With Neil Young’s Such a Woman playing, they tied the knot in Dirk’s flat, and instead of a wedding ring, he gifted her a heart shaped pendant on a chain.
What sets their relationship apart from that of simply a sex doll is that Dirk has forged a true genuine relationship with Jenny. He can hear her, talk to her and “perceive her soul”, believing she speaks back.

Documenting the couple’s day to day lives,the photographer, Sandra Hoyn, discovered the 40-year-old man bathed Jenny on Sundays, they wrote a blog together and watched football in front of the TV side by side. Dirk, however,  hasn’t told any of his family or friends, including his child from a previous marriage. When he has guests he conceals her in his bedroom and dims the lights.

The photographer’s biggest challenge, was coming to terms with treating Jenny as the person Dirk sees her to be; to not to just see the doll just as a doll, but to “recognize what the man sees and loves in her”. She actually started to feel her presence, and when Jenny was put in bed for a ‘sleep’, actually felt her voice volume lowering, afraid of waking her.
“I can’t live without love. My loneliness destroyed me.”. Dirk says of his silicone doll. Dirk carrying Jenny into the bathroom. He always has to remove the door so that Jenny fits through. “Jenny is such a sensitive being. She is so helpless.”. He said.


“Jenny gives me security. I never want to live without her again. I am moved from her words. The purity, serenity and honesty of her speaking.”.


“Jenny likes to wear beautiful clothes. But she does not care for brands.” Every Sunday Dirk washes her lace lingerie and wigs.

Dirk powders and massages Jenny’s feet. He cares for her silicone skin every Sunday after bathing to keep it soft.

Choi! Man leaves his car at car wash, comes back to find it smashed

According to the story, a man dropped his SUV at a car wash in Abuja for it be washed and left. And by the time he came back, the car had been practically destroyed. According to what happened, when the boys at the car wash heard that some FCT environmental taskforce were coming to the area, one of the boys jumped into the SUV and tried to drive the car away so it doesn't get seized by taskforce officials. But instead of moving the car, the inexperienced driver lost control of the SUV and smashed it into a fence. Above is how the car owner met his car when he returned to pick it up. DELSU student commits suicide after being jilted by lover of 7 years

A female student of Delta State University, Abraka, Evelyn Mogekwe, aged 26, allegedly jilted by her partner of seven years, committed suicide.

Sources said she was in a very good and cheerful mood in her hostel but her mood changed dramatically after man called her over the phone to end their long term relationship.

She was said to have bought some drugs, claiming she was having a headache and went into her room, leaving a message for her room mate that they might not see her again.

It was learned that a few minutes later, her room mate who sensed danger, raced into the room and found her lying lifeless on the ground.
The room mate then raised alarm which attracted other students to the room, but before help could be rendered, she had given up the ghost.

Confirming her death, the State Police Public Relations officers, DSP Celestina Kalu, said police  recovered particles of drugs on the ground beside the deceased.

Buhari's ADC orders DSS operatives out of Presidential Villa

It's been learnt that authorities of the Presidential Villa, Abuja, have formally removed officials of the Department of State Services from positions where they can perform 'close protection roles' for President Muhammadu Buhari.
The decision to restrict the officials’ access to the President was the peak of the inter-agency rivalry that has been rocking security agencies in the seat of power since Buhari was inaugurated on May 29.
The memo issued by the Aide-De-Camp to the President, Lt. Col. Lawal Abubakar, which was dated June 24, 2015 was titled, “Redeployment of Department of State Services personnel from close protection roles for Mr. President and some duty locations within the Presidential Villa, Abuja.”

The ADC directed personnel of the Armed Forces and the Nigeria Police who he said were trained as presidential body guards to take over the DSS officials’ duties of providing “close and immediate protection” for the President with immediate effect.

Abubakar explained that the decision to strip the DSS officials of their roles was part of an effort to enhance security within the villa which was necessitated by 'recent events' but he didn't say what the events were.

He listed the beats and locations from where DSS officials were withdrawn and replaced with PBGs to include the administrative reception and passage; service chiefs’ gate; residence reception; resident gate and office reception.

“However, the personnel of the DSS in conjunction with other security forces are to man other duty beats and locations within the immediate outer perimeter of the Presidential Villa,” the ADC wrote.

Meanwhile, officials of the DSS who were chased away from their beats on Wednesday were also not allowed access to their duty posts when they resumed work on Thursday morning.
Their beats had already been taken over by plain-clothed military personnel.
Many of them were seen under the trees discussing the development in hush tones.
Those who were manning the two of the gates leading to the villa as well as the gate of the old Banquet Hall were however not affected as they were seen at their duty posts.

Some of them wondered why whatever issue that could have arisen could not be resolved with the DSS authorities.
“If they feel that the DSS erred during the campaigns, some of us expect that they should also vent their anger on the management and not the entire DSS who served the President bewteen 1984 and 1985,” one of them said.
Another official said,
“Instead for the government to be promoting inter-agency rivalry in the country, they should have simply called the DG SSS to withdraw his operatives and not to set the military against the DSS. They should post us out instead of encouraging this unwarranted inter-agency rancour.”
The Presidency had in a statement by the Special Adviser to the President on Media and Publicity, Mr. Femi Adesina, on Wednesday said Buhari had not given any order for the expulsion of DSS officials from the Presidential Villa.

However, Adesina has admitted that a reorganisation of security at the seat of power was underway.

President Buhari appoints Accountant General of the Federation

President Buhari has appointed a serving director in the Federal Ministry of Mines and Steel Development, Ahmed Idris, as the new Accountant General of the Federation. The appointment was made known by the Head of the Civil Service of the Federation, Danladi Kifasi, through a statement by his Director of Communications, Haruna Imrana, today June 25th. The statement in part reads
“President Muhammadu Buhari has approved the appointment of Alhaji Ahmed Idris as the Accountant General of the Federation. The appointment takes immediate effect from 25th of June 2015″.

Senate's recess and matters arising

The adjournment of Senate's plenary to July 21, was meant to give the Senate Ad-Hoc Committees on Legislative Agenda and Review of the Senate's Finances time to conclude their work and submit their reports. The two committees were given one-week to submit their reports.
However, the Senate assured that it will reconvene at any time before the adjourned date to consider any matter of urgent national importance or to attend to any national assignment requiring its attention.
The Senate's Ad-hoc Committee on Financial review is the first time the Senate is setting up a body to review its own salaries, allowances, and the overhead cost of running the Senate with a view to realigning them to reflect the present economic situation in the country.

It could be recalled that the National Assembly had slashed its 2015 budget to N120billion from N150billion as a result of dwindling Federal Government's revenue.

The cut was part of the National Assembly's belt-tightening measures in view of the current economic realities in the country.

The Senate President, Bukola Saraki, had during the inauguration of the committee observed that the subject of reduction in cost of governance had been on the front burner of national discourse for a long time because of its extremely sensitive nature.

Saraki pledged that the Senate under his leadership would make "financial conservatism" its watchword.

The Senate President said: "There still persists the need to project clarity, accountability and transparency in all legislative matters and legislators’ welfare.

"The 8th Senate under our watch recognizes the concerns raised by Nigerians about the cost of running office most especially with the economic challenges facing our nation.

"The Senate will be more transparent regarding all public funds spent for the purpose of paying salaries and allowances of legislators and ensure that distinction is sufficiently made between what a legislator actually earns and what is spent to run and implement legislative business and committee activities.

"The watchword in our financial issues will be fiscal conservatism. It is therefore on this arm that the committee is mandated to carry out thorough fiscal examination on the Senate finances with the aim of  coming up with the best cost-effective regime in the 8th Senate."
